These Terms & Conditions ("Terms") are a legal agreement between you and MD. ARFIN HOSSIN PATWARY, trading as Foster — Grow Your Connection ("Foster", "we", "us"), Taraf Patwary Bari, West Fatehpur, Dagonbhuiyan, Feni - 3900, Bangladesh. By downloading, installing, or using Foster, you accept these Terms. If you do not accept them, do not use the app.

1. Eligibility and minimum age

You must be at least 13 years old to use Foster (and at least the age of digital consent in your country, if higher). Foster is a general-audience app and is not directed at children under 13; we do not knowingly collect data from children under 13. If we learn that a child under 13 has created an account, we will delete the account and its data.

2. Licence grant and restrictions

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Foster on devices you own or control, for personal, non-commercial use.

You may not:

• copy, modify, or create derivative works of the app;

• reverse engineer, decompile, or disassemble the app, except where that is expressly permitted by applicable law that cannot be excluded;

• scrape, harvest, or systematically extract data from the app or our servers;

• access the app with automated tools, bots, or scripts, or interfere with or overload our infrastructure (including automated abuse of the AI brainstorm feature);

• resell, sublicense, rent, or commercially exploit the app;

• use the app to violate any law or the rights of others.

3. Accounts and security

Some features require an account (sign in with Google, Apple, or your Supabase account). You are responsible for keeping your sign-in credentials and devices secure, and for all activity under your account. Tell us promptly at programmingwitharfin@gmail.com if you believe someone has accessed your account without permission. You may delete your account at any time (in-app: Settings → Delete Account; web: https://fosterapp.framer.website/delete-account).

4. Acceptable use

You agree not to use Foster to:

• harass, defame, stalk, threaten, or endanger anyone, or record information about people without a lawful basis;

• upload unlawful, infringing, hateful, sexually explicit, or violent content (e.g., in names, notes, or photos);

• infringe intellectual property or privacy rights;

• probe, scan, or test the vulnerability of our systems; or

• abuse the AI brainstorm feature with automated or excessive requests.

We may suspend or terminate accounts that violate these rules.

5. Your content ("User Content")

Content you create in Foster — names, notes, check-in records, reminders, photos you upload — belongs to you. You grant us a limited, worldwide, non-exclusive licence to store, process, transmit, and back up that content solely to operate the app for you (sync, reminders, the brainstorm feature). We do not use your content to advertise, and we do not make it public — Foster has no sharing, feed, or social features between users.

You are responsible for the content you store. Because your data is private to you, we do not pre-moderate it; if you believe any content accessible through the app is unlawful, contact us and we will act as required by law. You can delete any content yourself at any time, and deleting your account deletes everything.

6. Intellectual Property

The app, its design, code, and branding are owned by MD. ARFIN HOSSIN PATWARY and protected by copyright and other laws. Your data remains yours (§5). All trademarks of Google, Apple, RevenueCat, and Supabase belong to their owners.

7. Third-party services

Foster relies on third-party services — Supabase (hosting/database/auth), Google (sign-in, Gemini AI, Play Billing), Apple (Apple Sign-In, App Store), and RevenueCat (subscriptions). Their use of data is governed by their own policies (linked in our Privacy Policy §7). We are not responsible for third-party services, but we choose them carefully and contract with them as processors where applicable. The app may open external links (e.g., our website) — we are not responsible for the content of external sites.

8. Payments, subscriptions, and free trials

Products: an auto-renewing subscription ("Unlimited", monthly and/or annual) unlocks all gated features. Prices are shown in the app and in the store before purchase, in your local currency, and include applicable taxes where required.

• Billing & renewal: payment is charged to your Google Play / Apple account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period (Apple) or before the renewal date under your Play subscription settings (Google). Renewal charges occur within 24 hours before the end of the current period (Apple) or at the renewal date (Google).

• Free trials: if a free trial is offered, it is clearly labelled in the app before you start (for example, "Continue with 7-day free trial"). If you do not cancel before the trial ends, your subscription converts to a paid auto-renewing plan and billing begins. If you cancel during the trial, you keep access until the trial ends and are not charged.

• How to cancel: Android — Play Store → profile → Payments & subscriptions → Subscriptions. iOS — App Store → profile → Subscriptions. Deleting the app does not cancel the subscription.

• Refunds: purchases and refunds are handled by Google (Play refund policy) or Apple (Apple's refund request page), per their policies; you can also contact us at programmingwitharfin@gmail.com and we will help. Where your consumer law grants mandatory refund rights, those rights apply and these Terms do not limit them.

9. Disclaimers of warranty

Foster is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We disclaim all implied warranties, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that reminders will always fire on time (device settings such as battery optimization can affect this) or that AI-generated brainstorm suggestions are accurate or appropriate — they are starting points, and you decide what to say to people.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for all claims arising from these Terms or the app is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data (keep your own copies of anything important to you), lost profits, or lost goodwill.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including for death or personal injury caused by negligence, fraud, or your statutory consumer rights (including under the Australian Consumer Law and EU/UK consumer protection laws, where applicable).

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from your violation of these Terms or your misuse of the app, except to the extent caused by us.

12. Suspension and termination

You can stop using Foster and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the service (see §13). If we terminate your account for a breach, we will try to give you reasonable notice by email unless doing so is impractical or would break the law. On termination, your licence ends; §5 (content ownership) and §10 (liability) survive.

13. Changes to the service and to these Terms

We may add, change, or remove features. If a change materially reduces the core functionality you paid for during a subscription period, you may cancel and, where required by law, receive a pro-rata refund. We may update these Terms; we will update the "Last updated" date and, for material changes, give notice in the app or by email at least 7 days before the change takes effect. Continuing to use the app after changes take effect means you accept them; if you do not, delete your account and stop using the app.

14. Governing law and disputes

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules, and the courts of Bangladesh have non-exclusive jurisdiction. However: (a) you may also bring claims in the courts of your own country of residence if your consumer law gives you that right, and (b) mandatory consumer protections of your country of residence apply regardless of this clause. Before suing, please email us — we commit to respond to any complaint within 14 days and to try to resolve it in good faith.

15. Apple- and Google-specific terms

Google is not a party to these Terms. Google has no responsibility for the app, its content, or these Terms, and does not guarantee the app.

• Apple is a third-party beneficiary of these Terms and, upon your acceptance, has the right to enforce them against you as such. Apple is not a party to these Terms and is not responsible for the app.

• Apple has no obligation to furnish maintenance and support for the app.

• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (to the extent permitted); Apple has no other warranty obligation. Apple is responsible for addressing claims relating to the app, including product liability, legal/regulatory non-conformity, and consumer-protection claims. In the event of a third-party intellectual-property infringement claim relating to the app, we (not Apple) are solely responsible for the investigation, defence, settlement, and discharge.
